From 16 April, 2018 the Labour Hire Licensing Act 2017 will come into effect. This is a mandatory licensing scheme which has been designed to protect labour hire workers in Queensland from exploitation. Why are we telling you about this? Think that you’re NOT in the labour hire business? You may be surprised!!
Do you have several entities set up to run the different divisions of your business (or even different businesses)? Do you use an employee to work in two or more of these entities from time to time and on-charge their wages between the entities? If you do it means you may be considered to be in the labour hire industry!
What do you need to do if you are captured by this new legislation?
- From 16 April, you will have 60 days to lodge an application for a license
- In order to be eligible for a license you (or someone in your business) needs to satisfy the ‘fit and proper person’ test
- Your business must be financially viable
- You must provide six monthly reports on labour hire in relation to compliance with relevant laws
